CONDITIONS OF SALE AND CONSUMER INFORMATION (“Terms”)
The Terms contained in this document are our terms of supply and sale of the fashion goods and other items described in the catalogue in which these Terms appear. They will form part of any contract which we enter into with you
The Terms are subject to change without notice but you will find the latest version at www.elegance.co.uk and we will assume that you have referred to them if you do not ask us to supply the latest Terms by email or fax prior to placing an order with us. The contract between us comes into effect when you place a purchase order with us on and we accept that order. We have a legal duty to supply goods which conform with the contract between us
Availability is guaranteed only while stocks last. If we are unable to obtain goods ordered or cannot do so on terms commercially acceptable to us or not within time to deliver them to you within 30 days of acceptance of your order we will be entitled to cancel our agreement with you but if we do so we will immediately refund to you the monies you have paid to us including the cost of postage
We aim to despatch your goods as soon as we can and will try to do so within 14 days of receipt of your payment .and in any event undertake to deliver within 30 days. You will be allocated an order number on acceptance of your order by us. Delivery is only possible to an address provided by you within the UK excluding the Channel Islands and the UK‘s Overseas Territories.
We require a signature on delivery of your parcel. You agree that you will bear the risk in the goods once the parcel has been signed for. If delivery takes place before we are paid in full we will retain the property in and title to the goods supplied by us until full payment has been made by you and has been received by us.
The prices quoted in this catalogue are those ruling at the time of printing. All prices shown in this catalogue are cash prices and include VAT at the standard UK rate. Due to circumstances beyond our control, prices may have to be altered, up or down, including any alterations to the rate of value added tax.
The price at which the goods are to be sold and delivered will be confirmed to you before we accept your order and you may decline to proceed with your agreement to purchase should the price of the goods including delivery charges be any greater than the price shown in the catalogue or contained in these Terms.
Campaign vouchers are not available for purchase but are handed out by the provider as part of their advertising campaign. Campaign vouchers cannot be redeemed retroactively, cannot be combined with other promotions and are not valid for reduced goods (with the exception of campaign vouchers that are specifically for reduced goods, which are subject to separate regulations that are included with the respective campaign voucher).
You should inspect goods supplied within a reasonable time after their receipt. You will be deemed to have accepted the goods supplied unless during the period which commences on the day the contract between us comes into existence and ends on the expiry of fourteen days beginning on the day after delivery of the goods you notify us at the address below that the goods are rejected.
If no such action is taken we will consider the goods being as described, of satisfactory quality and fit for their purpose, and may not accept any rejection or cancellation at a later date however this does not affect your cancellation rights referred to below. A postage paid returns label will be included in each delivery, enabling you to return goods to us at no cost to yourself. Simply attach the label to the returns package and take it to the post office. This facility is limited to deliveries within the UK. It is also recommended that you obtain a certificate of posting so as to evidence despatch of the goods to us.
If goods are to be rejected pursuant to the above you will comply with the returns procedure set out above. In such circumstances we will accept any goods comprised in a cancelled order provided that you have taken reasonable care of the goods while they have been in your possession. We will refund the cost of rejected goods or cancelled orders (including reasonable postal charges) as soon as possible.

Right to cancel
You have the right to cancel his contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires,
(a) physical possession of the goods.
(b) physical possession of the last goods.
(c) physical possession of the last lot or piece.

of your decision to cancel this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can electronically fill in and submit the model cancellation form or any other clear statement on our website www.elegance.co.uk/cancellation.
To meet the cancellation deadline, it is sufficient for you to send your communication
concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. We will bear the cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Model cancellation form
The company is registered as a Data User under the Data Protection Laws applicable to the UK. The registry entry contains descriptions of the purposes, sources and disclosures of the personal data held by the company. Information collected is used to process orders and to carry out credit checking. For credit purposes we may consult the files of a credit reference agency who may record the search and may register details of your purchase. We may also pass your name and address to other companies whose products and services may be of interest to you. Please write to us at the address below if you prefer not to receive such offers.
Elégance designers take great care with the colours used in the collections. The limitations of printing may mean a slight variation. Every rea son able care has been taken to ensure that the descriptions are accurate. However, we reserve the right to change specifications without prior notice.
The items in the catalogue have been designed exclusively for Elégance and made to an exceptional standard of quality and cut.
If any part or parts of these Terms are deemed invalid, void or unenforceable then that part or parts will be considered severable from these terms and conditions thereby not preventing the remainder from being enforceable or effective. Nothing in these terms and conditions will reduce your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights contact your Local Authority Trading Standards Department or Citizens Advice Bureau. Any purchase by you of any goods will be governed by English law. Elégance reserves the right to accept or reject orders, or to close an account. This catalogue cancels all previous issues.
